The application form
Page #1: Select countries
On the opening page you can choose the countries where you wish to protect your sign as a registered trademark. You can also indicate if you are not the applicant but a representative ordering on behalf of the applicant.
Page #2: Applicant details
Please give us the contact details of the applicant (and the representative, if applicable). The information you give us will be stored in the browser cookies for use with further applications, next time you will not need to retype these.
Page #3: The mark and the list of goods & services
Here we require to give us the sign you want to protect. If the mark is a figurative logo, please upload a JPG file. This is also where you have to indicate what goods and services you wish to include in the trademark registration. This list defines where your mark will be protected. The list defines the scope of protection: the mark can still be used by others for other goods and services that are not similar to what you included in your list of goods.
Page #4: Send order and download POA forms
After you have given all the necessary details, you can send the order and make the payment online. Payment may be made by bank transfer and bank card. Don’t forget to download the Power of Attorney forms: in certain countries a written authorisation must be filed before the local authorities along with the application. These must be signed by the applicant. Please send the original copies of the signed Power of Attorney form(s) to the address located on the form itself by mail or by courier.
Payment
Please note that all costs must be paid by you when you place your order. GPP reserves the right to handle any case and to file any application only after having received the total payment.
If you pay by bank card, the payment is effected on the secure site of our bank. When submitting a payment on the SSL (Secure Socket Layer) interface you are connected directly to our Bank (K&H Bank Hungary is the affiliate of KBC Bank Belgium). Georg Pintz & Partners LLC does not receive or handle any information relating to your card, our firm receives only a short message about the payment from the bank.
Documentation
Along with the POA forms you can also download a Debit Note and the details of your application in electronic form. You will receive these by email too. We will also send you a reference number, you can use this to check the status of your applications and to download documents under the “Follow up” menu.
About the registration process
The registration process has several phases – depending on the country – and may take several months after we file your application. Formal examination is followed by the examination of possible grounds of refusal, these are the competence of the local authority (trademark office). As to relative grounds for refusal: in certain countries these are examined ex officio, in others they are not. In some countries the details of your application will be published by the trademark office, so anyone may file an opposition (objection before the authority) who feels that the registration of the trademark is contrary to their interest and previous rights. Read more about this under the “national info” menu.
It is possible that after we have filed the application there will be need for further action from you in order to complete the registration process. The costs related to these actions are not included in our standard fees. Such additional cost may be incurred if the official action of the authority or an opposition needs to be answered. Also, in some countries the applicant has to pay a registration fee at the end of the official procedure before the trademark is finally granted.
The administration of the trademark registration is the task of the local attorney in the countries where you are represented by a local partner of GPP (and not GPP directly). In these countries communication should be established between you and the attorney directly. You can find their contact details under the “national info” menu. If the applicant has to pay a registration fee at the end of the official procedure before the trademark is finally granted, the payment of this fee will be administered by the local attorney. In some cases it may become necessary to seek the services of a local legal representatives even in the cases where otherwise you are represented by GPP directly. We will inform you about such exceptional cases in due time.
After your trademark has been granted, usually it will not require the payment of further costs from you (an exception may be if someone starts a cancellation process against the trademark). It may mean an additional cost if you order a trademark watching service so that you will receive a notification from the provider of the service in case anyone wants to file a trademark that is similar or identical to yours. In such cases you can file an opposition against the new trademark application before the mark is registered.
Your trademarks will be valid and in effect for 10 years beginning from the filing date. The protection term can be renewed for further 10 year periods, but you need to file a request for the renewal, so mark the application date well and don’t forget to renew.
Warning: trade mark 'registers' of a non-official nature
An increasing number of applicants are receiving unsolicited mail from unofficial registration services asking for money in connection with trademarks and their registration. It has become a common practice of certain entities to approach the applicants and to offer their services and to make fee requests (usually in the form of debit notes) after the trademark has been published in the official bulletin. These are almost always fraudulent fee requests.
If you receive a letter or invoice, please check carefully what is being offered to you and whether it comes from an official source. If you receive an invoice concerning the trademark application from anyone other than your trade mark attorney, or an approach from any other company, please contact your attorney. Generally these companies have no connection with us or your representative.
